Dispute Resolution and Arbitration

All arbitration proceedings shall take place in the State of Florida, United States.

The arbitrator shall have exclusive authority to resolve any dispute and determine the enforceability of this provision.

Arbitration will be conducted on an individual basis only. You waive any right to participate in a class action or collective proceeding.

You waive your right to a trial by jury.

Either party may bring an individual claim in a small claims court located within the State of Florida, where applicable.

Each party shall bear its own costs unless otherwise determined by the arbitrator.

If D’Stella Crystals prevails, it may recover reasonable attorney’s fees and costs to the fullest extent permitted by law.

D’Stella Crystals reserves the right to seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or enforce these Terms.
